But State Senator John h. Eichelberger, Jr., President of the Senate Local Government Committee, said the city must have a share of responsibility in the regulation of abortion clinics, noting that it deals with issues such as prevention of diseases, nuisances for the building code violations, public health and waste collection. In the case of the provider of abortion Kermit Gosnell, he said, was the message of the city to the company: "We Don't care".
"Local monitoring must have a leading role," Eichelberger (r., Blair) said at the hearing at Drexel University. "Health services have the power to regulate."
The hearing came in response to the concerns of surveillance in a report by the horrific grand jury in January charged Gosnell murder in the death of a patient and seven end term babies who say that prosecutors are born living and dead. The report, which describes the filthy and horrible conditions in the West Philadelphia, severely reprimanded the State Health Department clinic for failing to close it.
Eichelberger, who opposes abortion, held at the hearing to discuss concerns about local monitoring, call the regulation of abortion clinics "joint responsibility".
But City Health Commissioner and Attorney Shelley Smith Donald Schwarz said that the city authority is limited when it comes to abortion clinics, now that the regulation of such facilities is the responsibility of the State Health Department. Schwarz, said that the city was developing procedures better to help people who want to file complaints with the State.
"I can't take someone's licence", said Schwarz. "The State has the power and the State has the capacity to regulate health care institutions."
Several bills are passing through Parliament which would impose more stringent regulations on clinics of abortion in response to the case of Gosnell.
